Tyler COLLINS, Appellant v. The STATE of Texas, Appellee

From the 227th Judicial District Court, Bexar County, Texas
Trial Court No. 2017CR4661
Honorable Kevin M. O'Connell, Judge Presiding

ORDER

Appellant's brief was initially due on July 20, 2020. Appellant has filed a motion for an extension of time requesting an extension of ninety days, or until October 18, 2020, to file his brief. Appellant's motion for extension of time to file his brief is GRANTED IN PART. Appellant's brief is due on or before September 18, 2020.

In his motion for extension of time to file his brief, appellant states that certain items related to pretrial matters have been omitted from the appellate record. Appellant further states he filed a motion to supplement the appellate record in the trial court and is waiting for the trial court to rule on this motion. However, the Texas Rules of Appellate Procedure provide that when relevant items are omitted from the appellate record "any party may by letter direct" the trial court clerk and the court reporter to supplement the record with the omitted relevant items. See TEX. R. APP. P. 34.5(c)(1); 34.6(d).
