Judgment and order of the County Court of Westchester county reversed and complaint dismissed upon the ground that said court acquired no jurisdiction of the subject-matter of the action, but as the question is first raised upon the appeal, without costs. Jenks, P.J., Hirschberg, Thomas, Carr and Rich, JJ., concurred.
