Colletti v. Waterfront Comm. of N.Y. Harbor

Appellate Division of the Supreme Court of New York, Second Department
Apr 21, 1986
119 A.D.2d 720 (N.Y. App. Div. 1986)

Opinion

April 21, 1986

Appeal from the Supreme Court, Kings County (Dowd, J.).

Judgment affirmed, with costs.

The plaintiff failed to offer any evidence to substantiate his claim that the property in question belonged to him. Defendant offered convincing evidence that the property belonged to someone else. Accordingly, summary judgment dismissing the complaint was appropriate. Weinstein, J.P., Rubin, Eiber and Spatt, JJ., concur.
