Appellate Division of the Supreme Court of New York, Second Department
Nov 1, 1907
122 App. Div. 908 (N.Y. App. Div. 1907)

Opinion

November, 1907.

Judgment modified so far as to permit the defendant to enforce subdivision K of rule 14, on the ground that there is not sufficient evidence to show that said rule is not reasonably necessary to insure the safe management of the defendant's trains, and as thus modified the judgment is affirmed, without costs. Jenks, Gaynor, Rich and Miller, JJ., concurred; Hooker, J., voted to affirm without modification.
