This case is currently calendared for trial during the Court's June 5, 2023, Memphis, Tennessee, trial session. On March 22, 2023, petitioners filed a Motion for Summary Judgment (Doc. 10). The Court notes that the Motion misstates the party filing the Motion.

On March 23, 2023, respondent filed a Notice of Objection (Doc. 11). Respondent's Notice of Objection represented to the Court that there are significant factual issues in dispute and therefore petitioner's Motion should be denied. The Notice of Objection further states that "respondent believes this case to be susceptible of settlement without necessity of trial or consideration of petitioners' motion" and that "[r]espondent and petitioners are working towards a resolution of this case."

Upon due consideration, it is hereby

ORDERED that petitioners' Motion for Summary Judgment filed March 22, 2023, will be held in abeyance pending the conclusion of the parties' settlement discussions.

The parties are reminded that this case remains calendared for trial during the Court's in-person June 5, 2023, Memphis, Tennessee, trial session scheduled to commence at 10:00 a.m. (Central Time).
