Cole v. Ryan

District Court of Appeal of Florida, Third District.
Sep 16, 2013
121 So. 3d 1050 (Fla. Dist. Ct. App. 2013)

Opinion

No. 3D13–2303.

2013-09-16

Geoffrey A. COLE, Appellant(s)/Petitioner(s), v. Timothy P. RYAN, etc., et al., Appellee(s)/Respondent(s).

The emergency petition for writ of habeas corpus is denied with respect to the order of indirect civil contempt on the merits. The petition is denied in all other respects without prejudice to petitioner's right to appeal the order of criminal contempt as habeas corpus does not lie to address the apparently improper criminal contempt proceeding pursuant to which the petitioner is not presently incarcerated.

SHEPHERD, C.J., and EMAS and FERNANDEZ, JJ., concur.
