Action for the partition of certain real property, brought to the Superior Court in the judicial district of New London at Norwich and tried to the court, Jones, J.; judgment ordering, inter alia, the sale of the subject property; thereafter, the court, Leuba, J., granted the plaintiff's motion to substitute James Wood as plaintiff and denied the named defendant's motion to vacate the judgment, and the named defendant appealed to this court. Affirmed.
