In an action for money had and received, plaintiff appeals from an order granting the motion of defendant Charles S. Michel to vacate the service of a summons and complaint upon him under section 229-b of the Civil Practice Act. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Carswell, Wenzel, MacCrate and Schmidt, JJ., concur. [See post, p. 918.]
