Order so far as appealed from modified by striking therefrom items 13, 19 and 21 and by inserting a provision permitting the introduction in evidence of plaintiff's books and papers, and as so modified affirmed, without costs. (See Zeltner v. Fidelity Deposit Company of Maryland, 220 App. Div. 21.) The date for the examination to proceed to be fixed in the order. Settle order on notice.
