An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about August 18, 2021, and said appeal having been perfected (Case No. 2021-03389), And plaintiff-appellant having moved for a stay of all proceedings in Supreme Court pending the hearing and determination of the aforesaid appeal, or in the alternative, pursuant to CLPR 5704(a), granting a temporary restraining order denied by a Justice of the Supreme Court, New York County, on or about November 8, 2021 (Case No. 2021-04370), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, and the interim relief granted by order of a Justice of this Court, dated November 26, 2021, is hereby vacated.
