ORDER

ROBERT D. BURNS, III, CHIEF JUSTICE.

Appellant's brief is overdue. On November 13, 2023, this Court notified appellant's counsel, Jeff Buchwald, that appellant's brief was overdue and directed him to file appellant's brief and a motion for extension of time to file the brief within ten days. On November 27, 2024, Mr. Buchwald filed a motion for extension of time to file the brief, which this Court granted, ordering Mr. Buchwald to file appellant's brief by January 11, 2024. On January 17, 2024, Mr. Buchwald filed a second motion for extension of time to file the brief, which this Court granted, ordering Mr. Buchwald to file the brief by February 5, 2024. As of the date of this order, appellant's brief has not been filed.

We ORDER appellant's counsel, Jeff Buchwald, to file appellant's brief and a motion for extension of time to file the brief on or before MARCH 4, 2024. If appellant's brief and motion for extension are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See Tex. R. App. P. 38.8(b)(2).
