Barry G. COGGINS, Appellant v. The STATE of Texas, Appellee
From the 437th Judicial District Court, Bexar County, Texas
Trial Court No. 2016CR2480
Honorable Lori I. Valenzuela, Judge Presiding
ORDER
Appellant's brief was due on November 27, 2017. Almost one month after the brief was due, Appellant filed a first motion for a sixty-day extension of time to file the brief. This court granted Appellant's motion but warned that " NO FURTHER EXTENSIONS OF TIME TO FILE APPELLANT'S BRIEF WILL BE GRANTED ." We ordered Appellant to file the brief not later than January 26, 2018. Nevertheless, on January 26, 2018, court-appointed counsel Edward F. Shaughnessy requested an additional forty-five days to file the brief until March 12, 2018.
We abated this appeal and remanded the cause to the trial court for an abandonment hearing—with specific questions for the trial court to answer. On February 13, 2018, the trial court filed its findings of fact and conclusions of law. It found that Appellant wants to maintain his appeal and continue to be represented by his retained counsel Edward F. Shaughnessy.
We REINSTATE this appeal. We ORDER Appellant's counsel Edward F. Shaughnessy to file Appellant's brief with TEN DAYS of the date of this order. NO FURTHER EXTENSIONS OF TIME TO FILE APPELLANT'S BRIEF WILL BE GRANTED.
