Present — Van Brunt, P.J., Patterson, O'Brien, Ingraham and Hatch, JJ.


Order reversed, with ten dollars costs and disbursements, and motion granted upon payment by defendant of all costs of action to present time.


On the authority of Varriale v. The Metropolitan Street Railway Company, decided herewith ( post, p. 633), the order appealed from should be reversed, with ten dollars costs and disbursements, and the motion granted upon payment by the defendant of all the costs of the action up to the present time.
