Coffin v. Kwasniewski

Appellate Court of Illinois, First District
Mar 31, 1941
309 Ill. App. 445 (Ill. App. Ct. 1941)

Opinion

Gen. No. 41,473. (Abstract of Decision.)

Opinion filed March 31, 1941

FORECLOSURE or MORTGAGES, § 172ownership of property, sufficiency of evidence. Foreclosure of trust deed was properly granted, where defendant's contention that she was not the actual owner of the property at the time the trust deed was given, that she told plaintiffs so, but that the trust deed was procured by threats of criminal prosecution of her husband, was improbable.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from Superior Court of Cook county; Hon. CHARLES A. WILLIAMS, presiding.

Order and decree affirmed. Heard in first division, first district, this court at October term, 1940.

John O. Wagner, for appellants;

Ross Berchem, Harold L. Reeve and Charles F. Grimes, for appellees.
