ORDER
Came on for consideration the above-captioned action wherein Michael Ray Coe is petitioner and Janie Cockrell, Director, Texas Department of Criminal Justice, Institutional Division is respondent. This is a petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2254. On December 20, 2002, the United States Magistrate Judge issued his findings, conclusions, and recommendation, and ordered that the parties file objections, if any, thereto by January 10, 2003. On January 13, 2003, petitioner filed objections.
Although petitioner filed his objections late, the court is considering them as if they had been timely filed. The court notes that the signature page is dated January 3, 2003.
The court has reviewed the record de novo in light of petitioner's objections. For the reasons set forth by the United States Magistrate Judge in the December 20, 2002, findings, conclusions, and recommendation, the court concludes that the petition should be denied. Therefore,
The court ORDERS that the petition be, and is hereby, denied.
