No. 05-07-01495-CR

Opinion Filed April 1, 2008. DO NOT PUBLISH. Tex. R. App. P. 47.

On Appeal from the County Criminal Court No. 5, Dallas County, Texas, Trial Court Cause No. MB05-38773-F.

Before Justices WHITTINGTON, RICHTER, and MAZZANT.

MEMORANDUM OPINION

Wilfred Lafayette Coburn was convicted of driving while intoxicated. Punishment was assessed at 180 days' confinement in jail, probated for twenty-four months, and a $400 fine. We adopted a finding that appellant no longer desires to prosecute the appeal, and we submitted the appeal without the reporter's record and briefs. See Tex. R. App. P. 37.3(c), 38.8(b). Absent briefs no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
