Memorandum Opinion


Dean Properties, Ltd. has filed notice in this court that it has assigned its judgment against Richard W. Weyand and Coastal Minerals, L.L.C. to Weyand Dean Properties also asserts that this appeal is now moot. Neither Coastal Minerals nor Weyand have responded to Dean Properties' assertion. We have reviewed the record before this court and agree that the appeal is now moot.

The appeal is dismissed.
