On Appeal from the 234th District Court Harris County, Texas
Trial Court Cause No. 2014-72030
MEMORANDUM OPINION
Appellant, The Community of Faith Church, appealed from the trial court's order, signed on June 22, 2015, granting the appellee's second Rule 91a motion to dismiss, after filing a motion for new trial. See TEX. R. APP. P. 26.1(a)(1). However, appellant has failed to timely file its appellate brief. See id. 38.6(a), (d), 38.8(a)(1). On February 22, 2016, the Clerk of this Court granted appellant's second extension of time to file its appellate brief, but notified counsel that no further extensions would be granted. After being notified on March 31, 2016, by the Clerk of this Court, that this appeal was subject to dismissal if appellant failed to file its appellate brief within ten days of the date of that notice, appellant failed to timely respond. See id. 38.8(a)(1), 42.3(c).
Accordingly, we dismiss the appeal for want of prosecution for failure to timely file a brief. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), (c). We dismiss any pending motions as moot.
PER CURIAM Panel consists of Chief Justice Radack and Justices Keyes and Higley.
