CECILIA CLINKSCALE, Appellant v. TEXAS WORKFORCE COMMISSION, Appellee
On Appeal from the County Court at Law No. 2 Travis County, Texas
Trial Court No. C-1-CV-13-006569 Before Morriss, C.J., Moseley and Burgess, JJ. ORDER
The reporter's record in this matter was filed November 7, 2016, and the clerk's record was filed November 10. The appellant's brief was originally due December 13, 2016, but that briefing deadline was extended twice, on appellant's motion, resulting in the most recent deadline of March 10, 2017. On March 27, 2017, the appellant filed a motion seeking a third extension of the deadline for filing her brief to March 29, 2017.
We initially note that the March 29 deadline sought by the appellant has come and gone, and we have still received no brief from the appellant. We have reviewed both appellant's third motion to extend the briefing deadline and the record on appeal, and we find no compelling information to convince us that additional time to prepare the brief in this matter is warranted. Consequently, appellant's motion is overruled.
By this order, we set the final deadline for filing appellant's brief as April 14, 2017. This order will further serve as notice under Rule 38.8 of the Texas Rules of Appellate Procedure that, should appellant fail to file a brief on or before April 14, this appeal will be dismissed for want of prosecution. See TEX. R. APP. P. 38.8(a)(1).
IT IS SO ORDERED.
