Clemons v. Aunt Fannie's Kitchen

District Court of Appeal of Florida, First District
Nov 20, 1991
588 So. 2d 699 (Fla. Dist. Ct. App. 1991)

Opinion

No. 91-2393.

November 20, 1991.

Petition for Writ of Certiorari — original jurisdiction.

Daniel L. Hightower, Ocala, for petitioner.

Patrick O. Helm, Gainesville, for respondents.

Wilma Powell Clemons filed a petition for writ of certiorari seeking to quash an order in which the judge of compensation claims (JCC) granted the employer/carrier's motion to compel cooperation with rehabilitation. We find this case indistinguishable from Strawter v. Atlas Fence, Inc. Claims Center, 578 So.2d 455 (Fla. 1st DCA 1991) and, therefore, grant the petition and quash the decision of the JCC.

ERVIN, WIGGINTON and WOLF, JJ., concur.
