ORDER TO SHOW CAUSE

Eunkyong Choi Special Trial Judge

This case is calendared for trial at the Court's April 11, 2023, New York City, New York trial session. On March 20, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Respondent's Motion alleges that since October 14, 2022,respondent has not heard from petitioner and has not received any additional information from petitioner to try and resolve this case.

Upon due consideration, it is hereby

ORDERED that, on or before April 5, 2023, petitioner shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution filed March 20, 2023,should not be granted and a decision entered against petitioner for the amounts and year set forth in respondent's Motion.

Petitioner is advised that the failure to respond to this Order may result in the dismissal of this case and entry of decision as requested in respondent's motion.
