This case was calendared for trial at the May 30, 2023, Winston-Salem, trial session of the Court. On May 4, 2023, respondent filed a Motion to Dismiss for Lack of Jurisdiction as to and to Strike As to Petitioner Trudy Cleere. This case was then called from the Trial Session of the Court at Winston-Salem, North Carolina on May 30, 2023.There was no appearance by, nor anyone on behalf of petitioner. Counsel for respondent appeared and was heard on the Motion.

Upon due consideration, and for cause more fully appearing in the transcript of the proceedings, it is hereby

ORDERED that respondent's Motion to Dismiss for Lack of Jurisdiction as to and to Strike As to Petitioner Trudy Cleere, filed May 4, 2023, is granted. It is further

ORDERED that the caption in this case is amended to read, "Robert Cleere, Petitioner v. Commissioner of Internal Revenue, Respondent."
