MEMORANDUM OPINION


In this case, Yonhi Kim Clayton was convicted of felony driving while intoxicated. See Tex. Pen. Code Ann. § 49.09 (Vernon Supp. 2005). Punishment was assessed at four years' imprisonment, probated for two years. Appellant, who is not indigent and is represented by counsel, did not file a brief. Therefore, we submitted the appeal without briefs. See Tex.R.App.P. 38.8(b)(4). Absent briefs, no points of error are before us. Finding no fundamental error, we affirm the trial court's judgment.
