EARNEST DEWAYNE CLAYTON, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the County Court at Law No. 1 Rockwall County, Texas Trial Court Cause No. CR17-2027

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

Before the Court is appellant's August 24, 2021 motion for an extension of thirty days for "the reporter's record [to] be filed, and that counsel may prepare the brief." In the motion, he states that co-counsel (who is not named in the motion or listed in the docketing statement filed June 5, 2021) paid for the reporter's record on June 24 and that court reporter Deborah Hamon indicated she might have the record completed by July 20, 2021. In light of this, we VACATE our July 16, 2021 order submitting this appeal without a reporter's record.

We ORDER court reporter Deborah Hamon to file the reporter's record within TWENTY DAYS of the date of this order.

We GRANT appellant's motion to the extent we order appellant's brief due by October 11, 2021.
