Present — Taylor, P.J., McCurn, Love, Vaughan and Kimball, JJ.


Judgment reversed on the law and a new trial granted, with costs to the appellant to abide the event, on the ground that the record presented a question of fact for the jury. All concur, except Love, J., who dissents and votes for affirmance. (The judgment dismisses plaintiff's complaint in a negligence action.)
