Judgment and order reversed on the law, with costs to the appellant to abide the event, and motion denied, without costs. All concur, except Cunningham and Taylor, JJ., who dissent and vote for affirmance. (The judgment and order dismiss plaintiff's second cause of action, in an action to recover for legal services performed.)
