Clawson v. Baker

Supreme Court of Florida
Mar 3, 1971
245 So. 2d 224 (Fla. 1971)

Opinion

No. 40741.

March 3, 1971.

Case of original jurisdiction — mandamus.

Bernard Berman, Miami, for petitioners.

Robert L. Shevin, Atty. Gen., and Reeves Bowen, Asst. Atty. Gen., for respondent.

This is an original proceeding in mandamus wherein Petitioners, charged with a crime, seek an alternative writ commanding the Respondent Judge to either dismiss a criminal case or show cause why he has not done so. The petition is denied and the proceedings are dismissed, on the authority of Clawson et al. v. Baker, Fla., 245 So.2d 224, (opinion filed March 3, 1971).

ROBERTS, C.J., and CARLTON, ADKINS, BOYD and DEKLE, JJ., concur.
