Before the Court are Tony Terrell Clark's Motion for Leave to Interview Members of the Venire Who Did Not Serve on the Petit Jury and the State of Mississippi's Response. After due consideration, the Court finds the motion should be denied.

IT IS, THEREFORE, ORDERED that Tony Terrell Clark's Motion for Leave to Interview Members of the Venire Who Did Not Serve on the Petit Jury is hereby denied.

KING, PRESIDING JUSTICE, AGREEING WITH THE ORDER WITH SEPARATE WRITTEN STATEMENT:

I agree that Clark's Motion for Leave to Interview Members of the Venire Who Did Not Serve on the Petit Jury should be denied. I write separately to clarify that the Court denies this motion because leave of the Court is not required to interview non-jurors. Nothing prohibits Clark's counsel from interviewing willing non-jurors.
