Sep 7, 1978
361 So. 2d 796 (Fla. Dist. Ct. App. 1978)

Opinion

No. 77-1450.

August 1, 1978. Rehearing Denied September 7, 1978.

Appeal from Circuit Court, Dade County; James Earnest, Judge.

Nachwalter, Christie Falk and Jay M. Levy, Miami, for appellants.

Adams Ward and Richard B. Adams, Corlett, Merritt, Killian Sikes and Gerald E. Rosser, Miami, for appellees.

Before PEARSON, HENDRY and KEHOE, JJ.

Plaintiffs appeal a summary final judgment entered in favor of defendants in an action for personal injuries resulting from a collision of motor vehicles. The record on appeal discloses that there are genuine issues of material fact which have not been eliminated by movants for summary judgment.

Reversed and remanded for further proceedings.
