Clark Const. v. Talmac

District Court of Appeal of Florida, Third District
Sep 12, 2007
964 So. 2d 783 (Fla. Dist. Ct. App. 2007)

Opinion

No. 3D06-1250.

September 12, 2007.

An Appeal from the Circuit Court for Miami-Dade County, Roberto M. Pieiro, Judge.

Duane Morris LLP, Boca Raton, and Jeffrey L. Hamera and Charles B. Lewis; Carlton Field and Alina Alonso, Miami, for appellant.

Robinson Associates and Raymond L. Robinson and Douglas C. Hiller, Coral Gables, for appellee.

Before COPE and RAMIREZ, JJ., and SCHWARTZ, Senior Judge.

This is an appeal from a final judgment entered in favor of Talmac, Inc., following a bench trial. We find no error of law and conclude that there was competent substantial evidence to support the judgment. See Pearce Pearce, Inc. v. Kroh Bros. Dev. Co., 474 So.2d 369 (Fla. 1st DCA 1985). It is not our function to reweigh the evidence and the credibility of the witnesses and substitute our judgment for that of the trial court. G G Fashion Design, Inc. v. Garcia, 870 So.2d 870, 873 (Fla. 3d DCA 2004).

Affirmed.
