This is an accelerated appeal challenging the trial court's denial of a motion to compel arbitration filed by appellant CJE Construction, LLC. Appellant filed its notice of appeal on June 11, 2024. On June 27, 2024, appellant filed a motion to stay the proceedings in the trial court in this case pending our resolution of this appeal.
Appellant argues that "if the trial court sets this case for trial, appellant will be prejudiced by being required to defend against [appellees'] claims in court and before a jury, despite appellant's right to enforce arbitration of [appellees'] claims and to obtain appellate resolution of such right prior to [a] jury trial and final judgment." Appellees have not filed a response.
The Court, having examined and fully considered the motion to stay the proceedings in this accelerated appeal, is of the opinion that the motion to stay should be granted. The motion is granted, and we stay all proceedings in the trial court pending further order of this Court. See Tex. R. App. P. 29.3.
