MEMORANDUM OPINION


This opinion disposes of all remaining issues in this consolidated appeal and original proceeding. The Court previously reversed the temporary injunction at issue. Consequently, the Court determines that submission set for April 5, 2005 is unnecessary. The Court suspends the rules of appellate procedure and immediately submits this original proceeding without oral argument. Tex. Rs. App. P. 2 and 28.3.

Relator Shawn Eiras's petition for writ of mandamus requests the Court order the city council of the City of Sherman to place relator's proposed ordinance on the ballot for the May 7, 2005 election. Based on the record presented, the Court concludes relator has failed to show himself entitled to the relief requested from this Court. Accordingly, the Court DENIES relator's petition for writ of mandamus. Tex.R.App.P. 52.8.
