ORDER

On March 24, 2017, appellant filed a Motion to Stay the trial court proceedings pending resolution of the City's interlocutory appeal. In its motion, appellant asks this court to stay the underlying trial court proceedings, including trial (which is set for April 3, 2017), hearings, and any discovery, pending resolution of this appeal. On April 5, 2017, a supplemental clerk's record was filed containing a copy of a "Stipulation to Stay Action," signed by the parties and filed with the trial court.

Because the parties agreed "that all proceedings are stayed until the Fourth Court of Appeals issues the mandate in Cause No. 04-17-00168-CV, or the Texas Supreme Court issues the mandate in any appeal to that Court," appellant's Motion to Stay filed in this court is MOOT.

Appellant is reminded that its brief is due April 18, 2017.
