Opinion
No. 04-15-00729-CV
06-07-2016
From the 229th Judicial District Court, Starr County, Texas
Trial Court No. DC-15-604
Honorable Migdalia Lopez, Judge Presiding
ORDER
On April 14, 2014, Appellants timely filed an interlocutory appeal challenging the trial court's order granting a temporary injunction. During the pendency of that appeal, the trial court held a hearing on Appellants' plea to the jurisdiction. On May 26, 2016, the trial court issued orders denying Appellants' pleas to the jurisdiction. On May 27, 2016, Appellants filed an unopposed motion asking this court to review the trial court's orders denying Appellants' pleas to the jurisdiction and to set a briefing schedule. Appellants request this court review the denial of their pleas to the jurisdiction in the instant appeal.
This court recognizes the outcome of the jurisdictional issues may affect any relief this court may grant with regard to Appellants' challenge to the trial court's order granting the temporary injunction. Therefore, the unopposed motion is GRANTED, and this court will consider Appellants' appeals from both the trial court's orders granting the temporary injunction and denying the pleas to the jurisdiction in this appeal. See TEX. R. APP. P. 29.6. Further the court GRANTS the expedited briefing schedule requested within Appellants' unopposed motion. It is ORDERED the parties will amend their briefs as follows:
• Appellants' amended opening brief is due no later than seven days from the date of this order;
• Appellee's amended opening brief is due no later than seven days from the date Appellants' amended opening brief is filed;
• Appellants' reply brief is due no later than seven days from the date Appellee files its amended opening brief.
