Granted.

TATE, J., concurs in the grant of the application as to the prescription issue, also noting that by exception of no cause of action filed in this court the State may raise the issue posed by Assignment 1.

It is ordered that the writ of review issue; that the Court of Appeal send up the record in duplicate of the case; and that counsel for plaintiff and defendant be notified.
