MEMORANDUM OPINION

The parties have filed with this Court a joint motion to dismiss this appeal. See TEX. R. APP. P. 42.1(a)(2). Pursuant to Rule 42.1(a)(2) of the Texas Rules of Appellate Procedure, see id., and in accordance with the parties' agreement, we vacate the trial court's judgment and dismiss this case. Costs of the appeal will be borne by the party incurring same.

We dismiss the appeal.
