This is an appeal from a judgment of dismissal. The facts and points of law being in all material respects identical with those in City of Los Angeles, Plaintiff, v. Abbott et al., Defendants; Robert L. Halperin, Defendant and Respondent (Cal.App.) 300 P. 854, this day decided, this case is governed by the decision therein.

Judgment affirmed.
