The question certified in the above stated cause to this Court for an answer is not such a question as falls within Rule No. 38 of this Court. 30 F.S.A. See Schwob Co. v. Florida Industrial Commission, 152 Fla. 203, 11 So.2d 782. The Court below, under Section 11 of Article 5 of the Constitution of Florida, F.S.A., has the power to adjudicate the question, which may be reviewed on appeal if desired.

SEBRING, C.J., and CHAPMAN, ROBERTS and MATHEWS, JJ., concur.
