Action to foreclose a mortgage. Order denying motion o, defendant Peter J. Harte to dismiss the complaint under rule 106, subdivision 5, Rules of Civil Practice, affirmed, with ten dollars costs and disbursements, with leave to said defendant to serve an answer within ten days from the entry of the order herein. No opinion. Lazansky, P.J., Young, Hagarty, Carswell and Davis, JJ., concur.
