An appeal having been taken from an order and judgment of foreclosure of the Supreme Court, Bronx County, entered on or about January 08, 2019, and defendant-appellant having moved for a stay of the sale of the subject property or enforcement of the aforesaid order and judgment pending hearing and determination of the appeal,
And an order of this Court having been entered (M-1454) on April 25, 2019, holding the aforesaid motion in abeyance pending the vacatur of or modification of the bankruptcy stay which resulted from the filing of a Chapter 13 petition in the Southern District of New York,
Now, upon reading and filing the correspondence from the attorney for defendant-appellant, dated April 29, 2021, and due deliberation having been had thereon,
It is ordered that the motion and appeal are withdrawn in accordance with the aforesaid correspondence. ENTERED: May 18, 2021
