By his own admission, Farzan did not deliver the summons and complaint to the state marshal until "around May 9th," which was not within the applicable limitations period. Pl.'s Resp. Nov. 12, 1997) ("Courts have allowed suits to proceed where the plaintiff has filed affidavits from the sheriff attesting that the sheriff received service within the time provided." (emphasis added)).
