An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about February 28, 2018, and said appeal having been perfected, And defendant-respondent having moved for summary affirmance of the lower Court's order, or in the alternative, for dismissal of the aforesaid appeal, and for sanctions,Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied without prejudice to defendant-respondent raising the arguments regarding summary affirmance or dismissal in respondent's brief on the appeal.
