PRELIMINARY PRE-TRIAL ORDER

LAURA TAYLOR SWAIN, District Judge

The parties having failed to file their Joint Preliminary Pre-Trial Statement as required by the Court's Preliminary Pre-Trial Order dated February 27, 2002, it is hereby

ORDERED, that the pre-trial conference scheduled for August 2, 2002 in the above-captioned matter is adjourned to August 20, 2002 at 3:00 p.m. in Courtroom No. 444, 40 Foley Square, New York, New York 10007, it is further ORDE RED, that the parties shall file their Joint Preliminary Pre-Trial Statement, as described in this Court's Preliminary Pre-Trial Order, no later than August 13, 2002 (the "Extended Date"); and further

ORDERED, that if (any) plaintiff fails to participate in the preparation and filing of the Joint Preliminary Pre-Trial Statement on or before the Extended Date, this action shall be dismissed with respect to such plaintiff; and further ORDERED, that if (any) defendant fails to participate in the preparation and filing of the Joint Preliminary Pre-Trial Statement on or before the Extended Date, such defendant shall be precluded from offering any evidence at the trial of this action.
