ORDER GRANTING I.N.S. MOTION TO DISMISS FOR MOOTNESS


Defendant United States Immigration and Naturalization Service having moved to dismiss this case for mootness, based on the Plaintiffs deportation to his native China on December 3, 2002; and the Court having reviewed the motion papers together with the entirety of the file; and good cause having been shown.

IT IS HEREBY ORDERED that the motion is GRANTED and this case shall be DISMISSED without prejudice. The Clerk is directed to send copies of this Order to the Plaintiff pro se at his Last known address at the CSC-INS Detention Facility, and to counsel for the INS.
