ORDER

CINDY K. JORGENSON, UNITED STATES DISTRICT JUDGE

Plaintiff in this action is deceased. His known successor or representative has been served with notice of his death and a copy of the Court's Order explaining that Plaintiff's death will end this action unless there is a substitution of another party as plaintiff. (Order (Doc 38)). There has been no motion for substitution by any party, representative, or successor.

Accordingly, IT IS ORDERED that this action is DISMISSED, pursuant to Fed.R.Civ.P. 25(a)(1).

IT IS FURTHER ORDERED that the Clerk of the Court shall close this case. Dated this 14th day of October, 2022.
