ORDER


AND NOW, this 12th day of April, 2004, upon consideration of Plaintiff's Motion to Compel Agere to Provide Discovery (Docket No. 112), defendant's opposition, and plaintiff's reply, IT IS HEREBY ORDERED that said motion is granted in part and denied in part.

The motion is granted to the extent it seeks discovery of documents Agere agreed to produce at the February 6, 2004, hearing. Agere says that such documents have been produced. Any such documents that have not been produced shall be produced on or before April 19, 2004. In all other respects, the motion is denied.

ORDER

AND NOW, this 12th day of April, 2004, upon consideration of Plaintiff's Motion to Compel Agere to Provide Discovery (Docket No. 121) and defendant's opposition, IT IS HEREBY ORDERED that said motion is DENIED as moot. Agere has agreed to produce the requested source code by May 5, 2004. That appears reasonable to the Court in view of all the circumstances.
