Before the Court is the motion of counsel Patrick Ballantyne for appellant. The motion states that Mr. Ballantyne will substitute as counsel for appellant's appointed counsel. We DENY the motion without prejudice because Mr. Ballantyne has failed to comply with Texas Rule of Appellate Procedure Rule 6.5(b). The Rules of Appellate Procedure require substitute counsel to deliver the motion to the party in person or through mail--both by certified and by first-class mail--to the party at the party's last known address. See TEX. R. APP. P. 6.5(b).
