NOTICE OF APPEAL


Notice is hereby given that DaimlerChrysler Corporation ("DCC"), defendant in the above named case, hereby appeals to the United States Court of Appeals for the Third Circuit from any and all rulings, orders, and decisions in any way adverse to DCC, including but not limited to the District Court's determination that Plaintiffs were "successful" under the California Code of Civil Procedure and awarding Plaintiffs Attorney Fees in the amount of $4,654,433.14, which includes but is not limited to the following Orders entered in this action:

1. Order granting Plaintiffs' Motion for Attorney Fees in the sum of $4,654,433.14 entered in this action on the 15th day of May, 2007 (Docket Entry No. 222);
2. Order Declaring Plaintiff David Chin to be Successful Under California Code of Civil Procedure entered in this action on the 9th day of November, 2006 (Docket Entry No. 214);
3. Order Granting Plaintiffs' Motion for Reconsideration and Vacating Order of Dismissal of the Action for Lack of Jurisdiction entered in this action on the 5th day of December, 2005 (Docket Entry No. 202);
4. Order Granting Reconsideration of December 14, 1999 Order entered in this action on the 13th day of August, 2003 (Docket Entry No. 193);
5. Order Granting Plaintiffs' Motion for Discovery on Catalyst Issue entered in this action on the 14th day of December, 1999 (Docket Entry No. 153);
6. Order Granting Motion for Entry of Final Judgment and Dismissal entered in this action on the 30th day of November, 1999 (Docket Entry No. 152); and
7. Order Denying Defendant's Motion to Dismiss, In Whole or In Part, All Five Counts of the Seconded Amended Class Action Complaint entered in this action on the 7th day of March, 1997 (Docket Entry No. 58).
