Children's Tel. Workshop v. Sesame Nursery

Appellate Division of the Supreme Court of New York, First Department
Mar 23, 1971
36 A.D.2d 713 (N.Y. App. Div. 1971)

Opinion

March 23, 1971

Order of the Supreme Court, New York County, entered July 15, 1970, granting plaintiff's motion for a preliminary injunction, unanimously affirmed, without costs and without disbursements. However, the parties having indicated their willingness to obtain an early trial, the circumstances of this case make it appropriate, in the interests of justice, that the cause be placed on the Ready Day Calendar for trial at the opening of the May 1971 Term upon service and filing of a note of issue and the payment of the proper fees.

Concur — McGivern, J.P., Markewich, Nunez, Kupferman and Tilzer, JJ.
