CHERYL C. Plaintiff, v. COMMISIONER SOCIAL SECURITY ADMINSTRATION, Defendant.


FINDINGS & RECOMMENDATION :

Plaintiff was ordered to make a filing with this court and was provided 30 days to do so. She was advised that a failure to make such a filing would result in the dismissal of this action for failure to prosecute and failure to follow a court order (#17).

Petitioner has not made the required filing. The five factors for dismissal discussed in Malone v. United States Postal Service, 833 F.2d 128 (9th Cir. 1987) have been weighed and indicate that dismissal is proper.

Conclusion

This action should be dismissed for failure to prosecute and failure to follow a court order.
